Waiver and Release of Liability

IMPORTANT: PLEASE READ CAREFULLY BEFORE PARTICIPATING OR ENROLLING

This document affects your legal rights. Participant Waiver, Release of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of being permitted to participate in any activities at Space City Tennis LLC ("SCT"), located in Texas, including but not limited to tennis training, lessons, clinics, tournaments, camps, court use, fitness training, and any related events. SCT makes no warranties regarding results, safety, or outcomes from participation.

 

  1. Acknowledgment of Risks: I understand that participation in tennis and related physical activities involves inherent and serious risks, including but not limited to slips, falls, collisions, overexertion, equipment failure, contact with balls, rackets, or courts, heat-related illness, and other foreseeable or unforeseeable hazards that could result in personal injury, illness, disability, paralysis, or death.
  2. Assumption of Risk: I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the ordinary negligence of SCT or others, and accept full responsibility for my participation.
  3. SCT does not provide medical advice. Participants should consult a physician before engaging in physical activity. Notify SCT of any medical conditions.
  4. Photo/Video Release: By participating, you (and on behalf of your minor child) grant SCT permission to use photographs/videos for promotional purposes without compensation.
  5. Release of Liability: I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Space City Tennis LLC, its owners, directors, officers, employees, coaches, agents, volunteers, and affiliates (collectively, "Releasees") from any liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, illness, or death, including those based on the ordinary negligence of the Releasees, to the fullest extent permitted by Texas law.
    THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM GROSS NEGLIGENCE, RECKLESSNESS, OR INTENTIONAL ACTS.
  6. Indemnity: I agree to indemnify, defend, and hold harmless the Releasees from any claims, losses, or expenses (including attorney's fees) brought by or on my behalf related to my participation.
  7. Governing Law: This agreement is governed by the laws of the State of Texas. If any portion is invalid, the remainder shall remain in effect.
  8. Participant acknowledges the inherent risks described above on behalf of myself and my child, and knowingly assumes all such risks, even if arising from the ordinary negligence of SCT. On behalf of myself, my spouse, my child, and our heirs/assigns, I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Releasees from liability for injury, illness, or death to my child, including ordinary negligence claims, to the fullest extent permitted by Texas law.
  9. I agree to indemnify the Releasees from any claims, losses, or expenses (including attorney's fees) related to my child's participation.
  10. Electronic Acceptance: Electronic acceptance of all SCT agreements (e.g., via online registration) is binding and equivalent to a handwritten signature.
