Space City Tennis Waiver and Release of Liability

In consideration of being permitted to participate in activities at Space City Tennis LLC ("SCT"), located in Texas, including but not limited to tennis training, lessons, clinics, tournaments, camps, court use, fitness training, and any related events. This document affects Participant Waiver, Release of Liability, Assumption of Risk, and Indemnity Agreement. SCT makes no warranties regarding results, safety, or outcomes from participation.

  1. Acknowledgment of Risks: I understand that participation in tennis and related physical activities involves inherent and serious risks, including but not limited to slips, falls, collisions, overexertion, equipment failure, contact with balls, rackets, or courts, heat-related illness, and other foreseeable or unforeseeable hazards that could result in personal injury, illness, disability, paralysis, or death.
  2. Assumption of Risk: I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the ordinary negligence of SCT or others, and accept full responsibility for my participation.
  3. SCT does not provide medical advice. Participants should consult a physician before engaging in physical activity. Notify SCT of any medical conditions.
  4. Photo/Video Release: By participating, you (and on behalf of your minor child) grant SCT permission to use photographs/videos for various purposes without compensation.
  5. Release of Liability: I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SCT, its owners, directors, officers, employees, coaches, agents, volunteers, and affiliates (collectively, "Releasees") from any liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, illness, or death, including those based on the ordinary negligence of the Releasees, to the fullest extent permitted by Texas law.
  6. Indemnity: I agree to indemnify, defend, and hold harmless SCT from any claims, losses, or expenses (including attorney's fees) brought by or on my behalf related to my participation.
  7. Governing Law: This agreement is governed by the laws of the State of Texas.
  8. Participant acknowledges the inherent risks described above and knowingly assumes all such risks, even if arising from the ordinary negligence of SCT. On behalf of myself, my spouse, my child, and our heirs/assigns, I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SCT for injury, illness, or death to my child, including ordinary negligence claims, to the fullest extent permitted by Texas law.
  9. Electronic Acceptance: Electronic acceptance of all SCT agreements (e.g., via online registration) is binding and equivalent to a handwritten signature.

 

Frank Black Middle School Court Usage Terms and Conditions

By using Frank Black Middle School (FBMS) courts and/or participating in Space City Tennis LLC (SCT) programs, you agree to the following terms and conditions:

1. General Use

  1. FBMS courts are used during designated hours as specified. Unauthorized use is prohibited. The courts are to be used for tennis/pickleball only. No unauthorized activities are permitted.

2. Reservation Policy

  1. Court usage requires booking. Users must reserve courts on the following website. Reservations must be canceled at least 24 hours in advance to allow others the opportunity to use the facilities.

3. Safety and Conduct

  1. All participants must conduct themselves respectfully and safely. Users must comply with any posted safety guidelines and instructions.
  2. Proper athletic attire and non-marking shoes must be worn at all times. Offensive language, disruptive behavior, or any form of harassment will not be tolerated.

4. Supervision and Responsibility

  1. Minors under the age of 14 must be supervised by an adult at all times while on FBMS courts. Users are responsible for their own belongings. FBMS is not liable for lost, stolen, or damaged items.

5. Damage and Maintenance

  1. Users are expected to respect school property. Any damage to the courts, equipment, or surrounding areas must be reported immediately. Users will be held financially responsible for any damage caused by misuse or negligence.

6. Prohibited Activities

  1. No glass containers or tobacco products are allowed on FBMS courts. Alcohol, drugs, and weapons are strictly prohibited on school property.
  2. Pets are not allowed on the courts, except for certified service animals.

7. Waiver of Liability

  1. By using the courts, users agree that FBMS School is not responsible for any injuries, accidents, or damages incurred while on school property. All users assume full responsibility for their participation and waive any claims against FBMS, SCT, and/ or related staff.

8. Enforcement and Penalties

  1. FBMS reserves the right to deny access to individuals or groups who violate these terms. Failure to comply with these terms and conditions may result in the suspension or revocation of court privileges.

9. Amendments

FBMS and SCT reserve the right to modify these terms and conditions at any time. Changes will be posted on the school's website or at the courts.

By using the FBMS courts and/or participating in SCT programs, you acknowledge that you have read, understood, and agreed to these terms and conditions.
